Jane Lowney

Karyn Reardon

Karyn is a partner at HWL Ebsworth and regularly drafts and reviews documentation for major projects, representing contractors, owners, superintendents, consultants, government departments, agencies and corporations, subcontractors, suppliers, financiers and insurers. Resolution of large construction and engineering disputes is Karyn’s particular area of interest.

She has a detailed understanding of alternative dispute resolution practices, with recognised expertise in adjudication, mediation, arbitration and expert appraisal, resolving a broad range of construction and engineering disputes. Ted is an infrastructure, construction and mining lawyer with Piper Alderman who has more than 25 years’ experience in both private practice and as general counsel.

Andrew Robertson

Andrew is Dispute Resolution Partner at Piper Alderman and has acted in a substantial number of successful complex litigious matters in various State and Federal Courts and he has acted for and advised clients across a wide range of industries and professions including building and construction, engineering, defence and professional practice. Andrew advises clients strategically about their dispute and how best to achieve the outcome they seek. He regularly appears in Court as counsel on behalf of his clients.

Andrew is skilled in achieving client outcomes through mediation, arbitration and other forms of alternative dispute resolution (ADR). He has over 25 years of experience in the construction and engineering industry working in both professional practice and construction contracting companies in Australia, Hong Kong,Malaysia, Singapore and the UK.

Robert is named in the Who’s Who Legal: Consulting Experts Guide, 2018 and 2019 as a leading expert in the field of Construction Quantum and Delay.Who’s Who Legal specifically says: “Robert Gemmell stands out for his deep understanding of delay and disruption costing and for his high-quality outputs” and Robert is also cited as “our expert of choice for large disputes”.

Robert has acted regularly as lead and support ExpertWitness, including giving evidence in court under oath, and has received over 100 appointments as Arbitrator, Adjudicator, Expert Determiner, in disputes ranging from several thousand to several hundredmillion Australian Dollars. Paul Newman

General Manager - Dial Before You Dig Queensland

Paul Newman is the General Manager of Dial Before You Dig Queensland, a position he has held for the past twelve years. Paul started his career as a carpenter followed by working for Australia’s largest telecommunications carrier (Telecom/Telstra) over a 23-year period. The last 7 years in Telstra Paul’s role was investigating and reporting on all major damages in Queensland, on Telstra’s optic fibre cable network. Paul was responsible for leading a team of field specialists in damage minimisation to ensure Telstra’s network was not being put at jeopardy by civil construction activities. Paul leads a dedicated team in Queensland who are driving the safe digging message across the state. Paul has been instrumental in the development and rollout in Australia with the Locator Certification Program which commenced in July 2015 and recognised as a national certification.

Paul is a member of the Australian Institute of Company Directors and is the company secretary for DBYD Qld and DBYD Certification Ltd.

Anne Kemp from Cbus Super has over 20 years’ experience in superannuation and client management for the building and construction industry. Anne is Brisbane based and is dedicated to supporting Queensland and Northern Territory businesses and their employees through their superannuation journey.

Anne is passionate about delivering quality retirement outcomes for members in the construction industry. Matthew Smith

Matthew is a Principal Lawyer and is the head of DWF’s national Employment, Safety and Regulatory team. He has over 20 years’ experience and works predominantly with government and major corporate entities in the construction, transport, mining and resources, manufacturing and retail industries. Matthew specialises in assisting clients to resolve highly-sensitive issues in often acrimonious litigated matters.

Matthew has extensive experience in the legal and strategic management of serious safety incidents, advising on incident management from the day of incident up to and including management of safety prosecutions and coronial inquests. Damian Hegarty

Principal Lawyer - DWF

Damian is a Principal Lawyer in DWF’s national Employment, Safety and Regulatory team. He has significant experience across a number of sectors, including construction, petroleum and gas, coal mining, manufacturing, environmental, retail, transport and electrical.

Damian has a particular focus on the defence of actions brought against companies or individuals by various regulators, which is complemented by his experience in public liability and workers’ compensation litigation.

He regularly provides advice to clients as to their rights and responsibilities during investigations undertaken by various regulators while forming a strategic position to defend or mitigate prosecutions, should they be brought as well as crisis management training for companies.

Damian also provides advice and assistance to clients embarking on the Enforceable Undertaking process and is called upon to undertake independent accident investigations. With this, Damian understands the interaction of employers’ health and safety policies and their insurance risk exposure.

Matthew’s health and safety and regulatory experience includes incident response and management, officer liability, notices to produce, coronial inquests and the defence of companies prosecuted by health and safety regulators.

Matthew also advises clients on employment issues, including unfair dismissal, general protections, discrimination, harassment, bullying, enterprise bargaining, building code compliance, underpayment of wages and employment contracts.

Whilst Mason has significant experience across all aspects of WHS and employment law, his areas of particular expertise include challenging notices (improvement, prohibition, infringement and similar) issued by health/safety Regulators, defending health / safety prosecutions, advising clients on union right of entry issues (specifically where the Fair Work Act and state WHS / OHS legislation interact), advising clients on lawfully terminating employees, and drafting contracts, policies and procedures.
